The use of services provided by WireNine.com (hereafter referred to as "WireNine") constitutes agreement to the following Terms and Conditions.

  1. Contact Information / Email on File

    Accounts are setup after payment has been received and the order has been screened by either us and/or our partner(s) in case of fraud. You are responsible for providing us with a valid email address which is not associated with the domain(s) you are signing up for. In case we need to get in touch with you regarding an abuse issue, or other account related matters, we will contact you on the primary email you signed up with. Customers are responsible for ensuring that their contact information is up to date at all times. If you have registered a domain with WireNine.com, you must verify that the contact information with your registered domain(s) is always correct and up to date. WireNine takes no responsibility for expired domain(s) due to outdated contact information. You can update your contact information at any time through the client billing portal. High risk transactions may be subject to further validation, we may require you to provide us with a scanned copy of your government issued identification and possibly a scan of the credit card used during sign up. If you fail to provide us with proper validation upon request, your order will rejected and marked as fraudulent.

  2. Transfers

    Website transfers are provided as a courtesy service and although our team will make every effort to move your site to WireNine’s servers, we cannot make any guarantees. Each web hosting company uses unique configurations which saves website data in an incompatible format, which may make it difficult if not impossible to transfer account data. If your old web host uses cPanel, our team can seamlessly initiate an account transfer on your behalf. The free transfer provided by WireNine is only available within 30 days of account registration after which period an account transfer request will incur a small charge.

  3. Website Content

    Services provided by WireNine are only legible to be used for lawful purposes – as per the laws of the United States of America and Canada. If you are hosting in the Europe division, the laws of Germany and United Kingdom also apply.

    As the customer, you agree to indemnify and hold WireNine harmless from any claims resulting from your use of our services.

    WireNine prohibits copyright and trademark infringement – this includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account in copyright violation will be immediately removed and access to the material may be disabled. Any account in consistent violation of copyright laws will be suspended and/or permanently terminated. If you believe that any account hosted with WireNine is in violation of the copyright agreement laid forth here, please email abuse@wirenine.com with the required information. Documentation may be required in order to follow through with account suspension/termination.

    WireNine offers its services to host websites, not to store data. Using an account as an online storage space for archiving electronic files is prohibited and may result in suspension and/or termination of your hosting services without notice.

    • Image Hosting Scripts (similar to Photobucket or Tinypic)
    • AutoSurf/PTC/PTS/PPC sites
    • IP Scanners
    • Bruteforce Programs/Scripts/Applications
    • Mail Bombers/Spam Scripts
    • Banner-Ad services (commercial banner ad rotation)
    • File Dump/Mirror Scripts (similar to rapidshare)
    • Commercial Audio Streaming (more than one or two streams)
    • Escrow/Bank Debentures
    • High-Yield Interest Programs (HYIP) or Related Sites
    • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
    • Sale of any controlled substance without prior proof of appropriate permit(s)
    • Prime Banks Programs
    • Lottery/Gambling Sites
    • MUDs/RPGs/PBBGs
    • Hacker focused sites/archives/programs
    • Websites that promote, distribute or link to warez/pirated/illegal content
    • Bank Debentures/Bank Debenture Trading Programs
    • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
    • Push button mail scripts
    • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
    • Tell A Friend Scripts
    • Anonymous or Bulk SMS Gateways

    Examples of prohibited material for VPS Hosting and Dedicated servers include:

    • IRCD (irc servers)
    • IRC Scripts/Bots
    • IP Scanners
    • Bruteforce Programs/Scripts/Applications
    • Mail Bombers/spam Scripts
    • Escrow
    • High-Yield Interest Programs (HYIP) or Related Sites
    • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
    • Sale of any controlled substance without prior proof of appropriate permit(s)
    • Prime Banks Programs
    • Lottery/Gambling Sites
    • Hacker focused sites/archives/programs
    • Websites that promote, distribute or link to warez/pirated/illegal content
    • Bank Debentures/Bank Debenture Trading Programs
    • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
    • Mailer Pro
    • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)

  4. Monitoring and Disclosures

    WireNine services, including all related equipment, networks and network devices are provided only for use by authorized customers. WireNine systems may be monitored for all lawful purposes, including ensuring that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of WireNine’s services constitutes the customers consent to monitoring for these purposes.

    Any account found connecting with a third party network or system without consent from the third party is subject to suspension. Any access to networks or systems outside of your direct control must be accompanied with written consent from the third party. WireNine may, if required, request documentation to provide evidence that access to a third party network or system is authorized.

    WireNine reserves the right to refuse or to cancel service to any prospective Customer or existing Customer for any lawful reason at any time. Any material that is judged to be obscene, threatening, illegal or found to be in violation of our terms of service may be removed from our servers or risk deletion, with or without notice.

    Our abuse department will contact you if there is any such issue with your account and failure to respond within 48 hours may result in the suspension or termination of your services. All abuse related issues must be handled via a support ticket or email and will have a response period of 48 hours.

    Websites hosted with WireNine’s services are subject to all regulatory U.S. laws. With this in mind, and in pursuance of Section 230© of the Communications Decency Act, we will not remove allegedly defamatory material from domains hosted on our servers – the only exception being if the material is found to be defamatory by an official court. WireNine.com is not in a position to investigate and or validate the authenticity of individual defamation claims, why is why we will rely on the courts to resolve such issues. In any case in which a legal court order indicates that the material hosted on your account is defamatory, slanderous or in violation of any copyright; access to the contents of your account will be disabled. Similarly, if a US court places an injunction against any specified content or material hosted on your account; WireNine will remove or disable access to the materials in question.

    The language of Section 230© of the Communications Decent Act clearly states that Internet service providers such as WireNine.com are re-publishers and not the publisher of content hosted on their servers. Our service merely provides a hosting platform and web space on which content is hosted – and any creation or publication of content on your services is the sole responsibility of the third-party user responsible for publishing the content. Therefore, WireNine.com should not and will not be held liable for any allegedly offensive, harassing, or copyrighted content published on sites hosted under WireNine’s web hosting service(s).

    If you are in doubt as to whether your web content is acceptable as per our terms of service, please contact us at abuse@wirenine.com and we will be more than happy to help you out.

    Any potential harm to minors is strictly forbidden, including but not limited to child pornography or any content perceived to be child pornography (Lolita):

    Any site found to be hosting any form of child pornography or linking to child pornography will be suspended and or terminated immediately without notice. Your account details may also be submitted to authorities if requested granted proper jurisdiction is provided.

    Resellers: in any case where a website is hosted under a reseller account, we will suspend the site on your behalf and contact you immediately so you may terminate the account. WireNine has the right to further monitor your activity; and any more than one infraction of this type may result in an immediate termination of your account (with or without notice).

    Direct Customers: your account will be terminated immediately with or without notice.

    Any and all violations of this policy will be reported to the appropriate law enforcement agency.

  5. Site Security and Updates

    It is the sole responsibility of the account owner to ensure that all scripts/programs installed in your web hosting space are up to update and secure, regardless of installation method. Failure to update and secure any installed programs or scripts may result suspension of your account until they are updated. Outdated scripts are the number 1 cause for compromised/hijacked accounts. All file and directory permissions must be secure. When possible, please set all directory permissions to 755 or as restrictive as possible/necessary. Customers are responsible for all actions taken under their account. This includes but is not limited to the compromise of login credentials (such as username and password). As the customer, you are required to use a secure password. If a weak password is used, your account may be suspended until you make your password more secure. Additionally, we may perform security audits to find weak passwords and notify you if your password is found to be weak/insecure, or may force a password change through the control panel by expiring your existing insecure/weak password. We can also change and email you a new password if your password is found to be weak/insecure or compromised.

  6. Zero Tolerance Spam Policy

    WireNine has a zero tolerance policy against sending of unsolicited e-mail, bulk emailing and spam. “Safe lists”, purchased lists, and selling of lists will be treated as spam. Accounts found to be sending spam will be terminated indefinitely with or without notice.

    Website advertised using SPAM (Spamvertised) cannot be hosted on WireNine's servers. This includes, but is not limited to SPAM sent via email, instant messaging, post mail, phone, fax, comment spam, or usenet/newsgroups. Organizations or entries listed in the ROKSO cannot be hosted on our servers. Accounts which result in our IP space being blacklisted will be immediately suspended and/or terminated.

    WireNine reserves the right to request changes or disable (as necessary) any web site, account, database, or other component that does not comply with its established policies -- or to make any such modifications in an emergency at its sole discretion.

    WireNine also reserves the right to charge the owner of the account that is used to send any unsolicited e-mail a clean up fee or any other charges incurred for blacklist removal. The cost of the clean up fee is variant on the degree of blacklist and is entirely at the discretion of WireNine.

  7. Payment Information

    Customer agrees to supply appropriate payment for the services provided by WireNine, in advance of the time period during which services are provided. Please note that special offers are limited-time promotional prices that are available to new customers and are only valid for the Initial term only, and not for renewals. WireNine will automatically renew Customer's Hosting Account by charging the applicable fee for the non-promotional price to Customer's current method of payment on file. You also agree that until and unless you notify WireNine of your need to cancel any or all services received, those services will be billed on a recurring basis based on your billing cycle.

    Unless a cancellation request is submitted, WireNine reserves the right to bill your credit card or any other billing method you have on file with us. WireNine offers a 10 day grace period from the time of invoice generation to the payment due date. Any invoice that is unpaid for 7 days after the payment due date will result in account suspension until the balance on the account has been settled. Access to the account will not be restored until payment has been received for the overdue invoice. Domain renewal notices and invoices are provided as a courtesy reminder from WireNine and we cannot be held responsible for a customer's failure to renew a domain or failure to notify a customer about a domain's renewal.

    Subsequently, all domain renewals are billed and renewed 30 days prior to the renewal date. It is your responsibility as the customer to notify our billing department via email (or ticket) at billing@wirenine.com for any domain registration you wish to cancel. No refunds can be given once a domain has been renewed -- all domain registrations and renewals are final.

    Invoices that have been paid more than once with multiple PayPal subscriptions due to the customers error can only be added as credit towards the account and cannot be refunded via PayPal. If you require any assistance with this matter, please contact billing@wirenine.com.

    WireNine is not responsible for any damages or losses as a result of suspension or termination for non-payment of your account. In addition, WireNine reserves the right to refuse to re-activate your Services until any and all outstanding invoice(s) have been paid in full.

    WireNine reserves the right to change the monthly payment amount and any other charges in conformity with the services provided.

  8. Backups and Data Loss

    Customer agrees that use of WireNine services is at Customer’s sole risk. Our backups run twice daily and create backups of your account dating up to 7 days back. This service is provided to you as a courtesy. WireNine is not responsible for files and/or data residing on your account. You agree to take full responsibility for all files and data transferred and to maintain all appropriate backups of files and data stored on your account. Under no circumstances shall the customer hold WireNine responsible for any loss of data. All customers should have dedicated recent data backups in the event data loss or corruption occurs.

  9. Cancellations and Money Back Guarantee.
    1. Cancellations

      Customers can cancel their account at any time requesting cancellation of their account from the client billing portal.
      Similarly, WireNine reserves the right to cancel, suspend, or otherwise restrict access to the Service(s) it provides at any time, for any or no reason, and with or without notice. WireNine is not responsible for any damages or loss of data resulting from such suspension or termination.

      Upon submitting the form, you will receive a submission confirmation in your email address on file with WireNine. We may contact you via email, ticket or phone to confirm your cancellation.

      If you do not hear back from us, or do not receive an automatic confirmation email after submitting your request, please contact us at billing@wirenine.com to confirm whether or not we received your cancellation request.

      If any manner of communication with WireNine's staff could be construed as belligerent, vulgar (curse words), attacking, highly rude, threatening, or abusive, you will be issued one warning. If the communication continues, your account may be suspended or terminated without refund. This includes, but is not limited to, threats to sue, slander, libel, publicly post, or initiate a chargeback.

    2. Money Back Guarantee and Refunds

      WireNine's shared and reseller plans carry a 60 day unconditional money back guarantee. VPS hosting offers a 30 day money back guarantee. If within 60 days of your purchase (30 days for VPS), you are not completely satisfied with WireNine's services, you will, upon request, receive a full refund of all hosting fees. All refund requests must be made through the billing department. Refunds will deduct the costs of any software licensing included free or purchased separately under your account.

      Free value-added services: If a customer has received a free domain name as part of their hosting contract, but elects to exercise their money back guarantee, the customer will receive a refund for all funds less setup fee (where applicable) and the domain registration fee of $10.00. Domain name registrations are not refundable by the registry to the Company, therefore the Domain name registration fee cannot be refunded to the Customer. If the customer has been issued a FREE SSL certificate as a part of their hosting plan, the refund will deduct the cost of the SSL certificate in the amount of $20.00. All software licensing costs will be deducted from the refund including licenses included free with any plan.

      The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:

      • Bank Wire Transfers
      • Western Union Payments
      • Checks
      • Money Orders
      • Account Credit Balances

      After the initial 60 days of account activation, no refunds will be issued. Cancellations requested outside the 60 day money back guarantee period are not eligible for a refund in part or in full. There are no refunds on account credits, balances, added funds, licenses, dedicated IPs, dedicated servers, administrative fees, SSL certificates, install fees for custom software, or domain name purchases.

      Under the money back guarantee, only first-time accounts are eligible for a refund. For example, if you've had an account with us before, canceled and signed up again, you will not be eligible for a refund. This is to protect our refund guarantee from being abused. If you cancel your account after the first 60 days have passed, or after your account is renewed then unfortunately we will not be able to issue any refunds.

      Violations of WireNine's Terms of Service will waive the refund policy.

  10. Chargebacks, Reversals, and Retrievals

    If WireNine receives a chargeback or payment dispute from a credit card company, bank, or Paypal, your Services may be suspended without notice. A $100 chargeback fee (issued to recoup mandatory fees passed on to WireNine by the credit card company), plus any outstanding balances accrued as a result of the chargeback(s), must be paid in full before service is restored. Instead of issuing a chargeback, please contact WireNine's billing team to address any billing issues.

  11. Fair-use Policies
    1. Resource Usage

      Customers may not:

      • Use 25% or more of system resources for longer than 90 seconds. Numerous activities including CGS scripts, FTP, PHP, HTTP, etc can cause such issues.
      • Run stand-alone, unattended server-side processes at any point in time. This includes and and all daemons, such as IRCD.
      • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
      • Run any software that interfaces with an IRC (Internet Relay Chat) network.
      • Run any BitTorrent application, tracker, or client. You are allowed to link to legal torrents off-site, but these cannot be stored on our shared servers.
      • Take part in any file-sharing/peer-peer activities.
      • Run any gaming servers (such as Counter-Strike, Half-Life, Battlefield, etc).
      • Run cron entries with intervals of less than 15 minutes.
      • Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.

    2. What "Unlimited" means.

      WireNine does not set arbitrary limits or caps on the amount of disk space or bandwidth a website can use. WireNine makes reasonable effort to provide its Customers with all the storage and bandwidth resources needed to power their web sites successfully, as long as the Customer's use of the service complies with these Terms.

    3. INODES Limits

      Shared accounts exceeding 200,000 inodes may receive a warning first, followed by a suspension if no action is taken to reduce the number of inodes. Every file on your account uses up 1 INODE. Accounts exceeding 20 GB of storage or 100,000 inodes are excluded from our backups, you are solely responsible for storing your own backups.

    4. Bandwidth Usage

      Your monthly bandwidth allowance is dependent on the hosting package you purchase. If your account exceeds the limit, WireNine reserves the right to suspend the account until the start of the next allocation or until more bandwidth is purchased at an additional fee or the account is upgraded to a higher level. Unused bandwidth does not transfer over to the next month.

  12. Uptime Guarantee

    In the event that your shared / reseller server has physical downtime and is not available for more than 99.9% within a month, you may be entitled to prorated credit according to our uptime guarantee. Approval of credit is at the discretion of WireNine.com upon valid justification provided. Third party monitoring services are not accepted as justification due to variety of factors including monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the OS (operating system) and web server.

    To request credit, please contact billing@wirenine.com with proper justification. Uptime Guarantees do not apply to VPS Hosting, or Dedicated servers as they are covered by a network uptime guarantee in which the credit may be prorated for the amount of time the server is offline.

  13. Reseller: Client Responsibility

    WireNine does not provide any end-user support to our reseller's clients. All resellers bear full responsibility for supporting their own clients. All support requests must be made by the reseller on their client's behalf for security reasons. Resellers are also responsible for all content stored or transmitted under their account and their clients'. WireNine will hold the reseller responsible for actions of their clients that violate any laws or any of WireNine's policies and Terms Of Service.

  14. Price Change

    The payment amount for hosting will never increase from your date of purchase. However, we reserve the right to change prices listed on WireNine.com, as well as the right to increase/decrease the amount of resources given to plans at any time.

  15. Promotional discounts and Coupons

    Discounts and coupons are reserved for first time, new customers only. You cannot use a coupon or promo code more than once for the same account at a later date. Coupon abuse will not be tolerated and could result in suspension and/or termination of the account. Coupons, promo codes, and/or discounts are valid for the initial purchase term only and do not affect the renewal and/or the recurring price of your plan.

    OTHER RESTRICTIONS MAY APPLY.

  16. Indemnification

    Customer agrees that it shall defend, indemnify, save and hold WireNine harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys’ fees, (“Liabilities”) asserted against WireNine, WireNine's affiliates, and each of their respective officers, directors, agents, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by Customer,its agents, employees or assigns. Customer agrees to defend, indemnify and hold WireNine harmless against liabilities arising from: (1) any injury to peron or property caused by any products sold or otherwise distributed in connection with WireNine; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from WireNine's servers.

  17. Disclaimer

    Customer agrees that use of WireNine's services is at Customer's sole risk. WireNine does not warrant or represent that the services will be uninterrupted, error-free, or completely secure. WireNine is not responsible for any damages your business may suffer. WireNine makes no warranties of any kind, expressed or implied for services we provide. WireNine disclaims any and all warranties for a particular purpose. This includes but is not limited to loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by WireNine and its employees.

  18. LIMITED LIABILITY

    Under no circumstances, including negligence, shall WireNine, or its employees be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use WireNine's service; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft or destruction or unauthorized access to WireNine's records, programs, or services. Customer hereby acknowledges that this paragraph shall apply to all content on WireNine's service.

    Notwithstanding anything else in this agreement to the contrary, the maximum aggregate liability of WireNine and any of its employees, agents or affiliates, under any theory of law (including breach of contract, tort, strict liability, and infringement) shall be a payment of the money not to exceed the amount payable by customer for three months of service.

  19. Disclosure to Law Enforcement

    WireNine may disclose any customer information to law enforcement agencies without consent or notification to the customer upon appropriate lawful request from such agencies. We will co-operate fully with law enforcement agencies.

  20. Changes to Terms of service

    WireNine reserves the right to revise its policies and/or content at any time without notice.
